Clarification of Verbatim Records Provisions
House Bill 4247 amends the Open Meetings Act.
The bill removes the requirement under existing law that public bodies must review the recording every six months. The existing law also requires that if information on the recordings is no longer considered confidential; the public body may have to release the portion of the tape that is no longer confidential. As with the existing law, the bill requires all public bodies to keep minutes of all closed meetings. In addition, the bill prohibits the inspection of the verbatim record of a closed meeting, including for discovery purposes, in a judicial proceeding other than in a judicial proceeding to determine whether the Act has been violated.
